Vineyard Tracker Terms of Use

These Terms of Use govern your access to and use of the Vineyard Tracker mobile application, website pages relating to Vineyard Tracker, and any related services provided by us. By downloading, accessing, subscribing to, or using Vineyard Tracker, you agree to these Terms of Use. If you do not agree, you must not use the app.

1. About Vineyard Tracker
Vineyard Tracker is a vineyard record-keeping, operational support, and workflow tool designed to assist users with field observations, mapping, spray records, growth stage tracking, reporting, and related vineyard management activities. Vineyard Tracker is provided as an informational and administrative support tool only.

2. No Professional Advice
Vineyard Tracker does not provide agronomic, viticultural, horticultural, chemical, legal, safety, compliance, or other professional advice. Any content made available through the app, including user-entered records, automated summaries, suggestions, calculations, alerts, reports, and AI-generated information, is provided for general informational purposes only.

You are solely responsible for independently reviewing and verifying all information before relying on it. You must use your own judgment and, where appropriate, obtain qualified professional advice before making decisions relating to disease identification, disease prevention, spray programs, chemical use, compliance obligations, crop treatment, irrigation, nutrition, harvest timing, or any other vineyard operation.

3. AI-Generated Content
Vineyard Tracker may include features that generate content automatically, including through artificial intelligence or other automated systems. AI-generated content may be incomplete, inaccurate, not suitable for your circumstances, or out of date.

You acknowledge and agree that all AI-generated information must be checked by you before use. You must not rely solely on AI-generated content for decisions involving plant health, disease, spray applications, chemical selection, withholding periods, safety requirements, legal compliance, or commercial decisions.

4. Disease and Crop Outcomes
We do not guarantee any disease prevention, disease control, crop performance, yield, fruit quality, compliance outcome, or operational result from your use of Vineyard Tracker.

To the maximum extent permitted by law, we accept no responsibility or liability for disease outbreaks, misdiagnosis, failed treatments, crop loss, reduced yield, reduced fruit quality, business interruption, compliance breaches, or any other loss or damage arising from or connected with your use of the app or reliance on any information in it.

5. User Responsibility
You are responsible for:

all decisions made using the app;
checking the accuracy of records, maps, observations, and reports;
ensuring that your chemical use, spray programs, and farming practices comply with applicable laws, labels, permits, directions, and industry requirements;
ensuring safe use of machinery, field operations, and workplace systems;
maintaining appropriate backups of any important data you enter into the app.

6. Account and Access
You may need to create an account to use some features of Vineyard Tracker. You are responsible for maintaining the confidentiality of your login details and for all activity that occurs under your account.

You must provide accurate information and keep it up to date. We may suspend or terminate access if we reasonably believe that your use of the app is unlawful, abusive, harmful, fraudulent, or breaches these Terms.

7. Subscriptions and Billing
Vineyard Tracker may offer auto-renewable subscriptions that provide access to premium features. Subscription terms, including duration, pricing, trial offers, and billing terms, will be shown in the app before purchase.

Payment will be charged through your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours before the end of the current period. You can manage or cancel your subscription in your Apple account settings after purchase.

Any free trial, promotional period, or introductory offer, if provided, will be subject to the terms presented in the app at the time of offer.

8. App Store Terms
If you downloaded Vineyard Tracker through Apple’s App Store, you also acknowledge that your use of the app may be subject to Apple’s applicable terms, including App Store usage rules. If you choose to rely on Apple’s standard Licensed Application End User License Agreement instead of a custom EULA, Apple provides that standard agreement separately.

9. Privacy
Your use of Vineyard Tracker is also governed by our Privacy Policy, which explains how we collect, use, and store personal information and app data. By using the app, you consent to the handling of information as described in the Privacy Policy.

10. Acceptable Use
You agree not to:

use the app for any unlawful or improper purpose;
interfere with or disrupt the app or its systems;
attempt to gain unauthorized access to any part of the app or related systems;
copy, reverse engineer, modify, distribute, sell, or exploit the app except as permitted by law;
use the app in a way that could harm us, other users, or third parties.

11. Availability and Changes
We may update, modify, suspend, or discontinue any part of Vineyard Tracker at any time, including features, pricing, subscription inclusions, or supported devices. We do not guarantee that the app will always be available, error-free, or uninterrupted.

We may also update these Terms from time to time. Continued use of the app after updated Terms are published constitutes acceptance of the updated Terms.

12. Intellectual Property
All rights, title, and interest in Vineyard Tracker, including its software, design, branding, content, and underlying systems, remain our property or the property of our licensors. These Terms do not transfer any ownership rights to you. You are granted a limited, revocable, non-exclusive, non-transferable right to use the app for its intended purpose in accordance with these Terms.

To the maximum extent permitted by law:

Vineyard Tracker is provided on an “as is” and “as available” basis;
we exclude all warranties, representations, and guarantees except those that cannot legally be excluded;
we are not liable for any indirect, incidental, special, consequential, or punitive loss or damage;
we are not liable for loss of profits, revenue, crops, production, business opportunity, goodwill, data, or anticipated savings;
where liability cannot be excluded, our liability is limited to the minimum extent permitted by law.

Nothing in these Terms excludes any rights or remedies you may have under applicable consumer law, including the Australian Consumer Law, that cannot be lawfully excluded.

14. Termination
We may suspend or terminate your access to Vineyard Tracker at any time if you breach these Terms or if we reasonably need to protect the app, our users, or our business. You may stop using the app at any time. Any provisions that by their nature should continue after termination will continue, including provisions relating to liability, intellectual property, and dispute rights.

15. Governing Law
These Terms are governed by the laws of New South Wales, Australia, unless otherwise required by applicable law. You submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts of appeal from them.
